1. GENERAL

1.1

These general terms and conditions ("Terms") apply when you as a consumer ("You") place an order via www.homeartngallery.com, and related pages, ("Site"). Agreement is concluded between you and

Home Art ´N´ Gallery AB, organization number 559277-9762 ("Home Art ´N´ Gallery"). Detailed contact details and other information about Home Art ´N´ Gallery can be found on the page. The terms and conditions are only applicable to you who are consumers and who place orders via the site. 

1.2

To be able to order on the site, you must be 18 years old. Home Art ´N´ Gallery, according to Swedish law, does not accept credit purchases for people under 18 years of age.

Home Art ´N´ Gallery reserves the right to refuse or change your order in individual cases (for example if you have provided incorrect personal data and/or have payment complaints).

1.3

Home Art ´N´ Gallery reserves itself for final sales and any image and writing errors on the Page, for example errors in product description or technical specification, incorrect prices and price adjustments (such as changed prices from suppliers or currency changes) or incorrect information regarding whether an item is available in stock. Home Art ´N´ Gallery has the right to correct any such errors and to change or update the information at any time. If an incorrect price has been entered for an item you have ordered, Home Art ´N´ Gallery will of course notify you of this and await your approval of the corrected price before Home Art ´N´ Gallery continues with the order. All image information on the Page must be viewed exclusively as illustrations. Such illustrations cannot guarantee the exact appearance of the item. Home Art ´N´ Gallery is not responsible for information on the Page that comes from a third party.

1.4

The page, as well as all content on it, is owned by Home Art ´N´ Gallery or its licensors. The information is protected by, among other things, intellectual property and market laws. This means that trademarks, company names, product names, images and graphics, design, layout and information about goods, services and other content may not be copied or used without written approval from Home Art ´N´ Gallery.

2. AGREEMENT AND ORDER
 

2.1

In order to make a purchase via the Site, you must accept the Terms and Conditions. By accepting the Terms and Conditions, you undertake to follow the Terms and Conditions in their entirety, as well as agree that you have read the information about personal data and consented to the use of personal data and cookies according to the Home Art ´N´ Gallery Privacy Policy, see here

2.2

A purchase agreement is only entered into when Home Art ´N´ Gallery has confirmed your order and you have received order confirmation from Home Art ´N´ Gallery by e-mail. Home Art ´N´ Gallery invites you to save this order confirmation for any contact with Home Art ´N´ Gallery customer service. You can cancel your order until it has been confirmed by Home Art ´N´ Gallery. If the order is cancelled, Home Art ´N´ Gallery will refund any payments that You or your debit or credit card companies have made regarding the order.

3. CUSTOMER INFORMATION, ETC.
 

3.1

When you register your user account and/or place an order, you will be asked to provide certain personal data. You confirm that the information you fill in is correct and complete and are responsible for incorrectly filled information. 3.2

You undertake to ensure that no one else can use your login details. You may not disclose username and password to any unauthorized person and must ensure that documents containing information about username and password are stored in such a way that unauthorized persons cannot gain access to the information. You must immediately report to Home Art ´N´ Gallery if it is suspected that an unauthorized person has gained access to your password. You are responsible for all purchases made with your login details if such notification has not been made.

3.3

If Home Art ´N´ Gallery suspects that you are abusing your user account or your login details or otherwise violate the Terms and Conditions, Home Art ´N´ Gallery has the right to suspend you. Home Art ´N´ Gallery also has the right to assign you new login details.

4. PRICES, FEES AND PAYMENT
 

4.1

When ordering via the Site, the prices specified on the Site apply. Prices are stated in Swedish kronor and include VAT. Prices do not include payment and shipping fees, which are listed separately.

Home Art ´N´ Gallery has the right to charge already in connection with the order, unless invoice payment or another similar payment method has been chosen by you and approved by Home Art ´N´ Gallery. In case of invoice payment or partial payment, Home Art ´N´ Gallery or its partners may make a credit report. In such case, you will be informed about this. Home Art ´N´ Gallery reserves the right not to always offer all payment methods, or to change the payment method if the one you have chosen for some reason does not work at the time of purchase. Please note that any restrictions on payment options are indicated on the Page.

 

5. PROMOTIONS AND OFFERS

Home Art ´N´ Gallery may from time to time offer promotions on the Site which may have more favorable terms than what appears in these Terms, e.g. regarding payment or extended right of withdrawal. These more favorable conditions apply as long as the campaign is active and for the specific goods specified by Home Art ´N´ Gallery in connection with the campaign. Home Art ´N´ Gallery reserves the right to withdraw such promotions at any time. In the event of termination or cancellation of a campaign, these Terms apply without modification. Offers on specific items at Sidon are valid for a limited time and while stocks last.

 

6. GIFT CARD

Gift cards sold at Home Art ´N´ Gallery are valid for two (2) years from the date of issue and can be used at the Home Art ´N´ Gallery webshop. Once the validity period has expired, the card cannot be used as a means of payment, cannot be reactivated and the remaining value cannot be refunded. Your gift card is a document of value that must be kept securely and cannot be exchanged for money.

Lost or stolen cards are not replaced.

7. DELIVERY AND TRANSPORT
 

7.1

Goods that are in stock are normally delivered within the number of working days specified on the Page. Unless otherwise specifically agreed (e.g. in connection with the booking of goods that are not in stock), delivery takes place no later than 30 working days after Home Art ´N´ Gallery has confirmed the order in writing through the order confirmation. 7.2

The expected delivery time of the product is shown in the order confirmation, in the checkout and/or on the current product page on the Site. Unless otherwise specifically agreed and a delivery takes more than 30 working days and this is not due to you as a customer, you have the right to cancel the purchase.

7.3

If packages are to be redeemed, you must do this within the time specified in the notification. Packages must normally be picked up in person with valid identification and order number. You always receive a notification that shows where and when packages are to be picked up. Notification can take place via e-mail, regular mail and, if you have provided a mobile number, also via phone calls or SMS. If you do not pick up the package, Home Art ´N´ Gallery has the right to charge you a fee of SEK 175. For home delivery, there needs to be a person available to receive the package.

8. RIGHT OF WITHDRAWAL
 

8.1

When purchasing goods atPage 90-day right of withdrawal always applies. This means that you have the right to cancel your purchase by notifying Home Art ´N´ Gallery of this within 90 days from when you or your representative received the ordered item (the cancellation period). The right of cancellation or exchange does not apply to personal posters that are personalized and printed to order. The goods must be returned in the same condition as they were in when delivered to you. If the item has clearly been used, Home Art ´N´ Gallery has the right to make a deduction from the compensation.

8.2

In connection with an order for goods for which the right of withdrawal does not apply, you will receive clear information about this. If an item has been sealed, you must not break the seal if you want to be able to exercise your right of withdrawal. The right to regret therefore ends when you break the seal.

8.3

If you want to cancel the purchase, you must, before the cancellation period expires, send a clear message to Home Art ´N´ Gallery. You must enter your name, address and other relevant information, e.g. order number, invoice number and name of the item in the message.

8.4

When exercising the right of withdrawal, you pay the return shipping and are responsible for the condition of the goods after you have received the goods and during the return shipping. The item must be returned within 30 days from the date on which notice of the exercise of the right of withdrawal was given to Home Art ´N´ Gallery. The item must be sent well packaged, in good condition and in the original box. 

NOTE: When returning canvas, the customer uses his right of withdrawal. The customer must pay for the return charges and is responsible for the condition of the product after the customer receives the product, as well as during its return delivery.

8.5

When you cancel your purchase, Home Art ´N´ Gallery will refund the amount you paid for the item, excluding delivery costs. From the amount to be refunded, Home Art ´N´ Gallery has the right to deduct an amount corresponding to the decrease in value of the item compared to the original value of the item, if and to the extent that such decrease in value is due to You having handled the item to a greater extent than is necessary to determine its properties or function.

8.6

Home Art ´N´ Gallery will repay the amount as soon as possible, but no later than within 14 days from the date Home Art ´N´ Gallery received your notice of exercise of the right of withdrawal.

However, Home Art ´N´ Gallery may wait with the refund until Home Art ´N´ Gallery has received the item or You have shown that the item has been sent back, e.g. through a submission receipt. The refund will be made to you via the payment option you chose, provided that nothing else has been agreed or that there are obstacles to such refund.

9. WARRANTY AND COMPLAINTS
 

9.1

Some of the Home Art ´N´ Gallery goods may be covered by warranty. Information about any warranty period and special warranty conditions for each product can be found on the Page or in these Terms and Conditions. Warranty for goods only covers original manufacturing defects, and thus not defects that occur during or after an own change to the function and appearance of the product, such as rebuilding, upgrading or other configuration of the product. Your order confirmation is valid as proof of warranty.

9.2

The right of complaint covers goods that are faulty according to current consumer protection legislation. A customer who wishes to claim an error in an ordered item must contact Home Art ´N´ Gallery as soon as possible after the error is discovered via the contact details provided on the Page. Complaints made within two months from when you discovered the fault are always considered to have been submitted in time. You have a 3-year right to complain about goods purchased on the Site.

9.3

Home Art ´N´ Gallery is responsible for the return shipping for approved complaints.

9.4

When the claimed item is returned and the claim is approved, Home Art ´N´ Gallery will compensate you in accordance with current consumer protection legislation. Home Art ´N´ Gallery strives for this to take place within 14 days of Home Art ´N´ Gallery receiving the complaint, but it may take longer depending on the nature of the item. Home Art ´N´ Gallery reserves the right to refuse a complaint if it turns out that the product is not faulty according to current consumer protection legislation. 10. LINKS

Home Art ´N´ Gallery may link to other websites that are outside of Home Art ´N´ Gallery's control, and websites outside of Home Art ´N´ Gallery's control may link to the Site. Although Home Art ´N´ Gallery tries to ensure that Home Art ´N´ Gallery only links to websites that share Home Art ´N´ Gallery personal data and security regulations as set out in the Privacy Policy, Home Art ´N´ Gallery is not responsible for the protection or confidentiality of information or personal data that you provide on other websites. You should exercise caution and read the personal data regulations for the relevant Page.

11. FORCE MAJEURE

Home Art ´N´ Gallery is not responsible for delays caused by circumstances beyond Home Art ´N´ Gallery's control, such as for example general labor disputes, extreme weather conditions, war, fire, lightning, terrorist attack, changed government regulations, technical problems, faults in electrical /tele-/data connections or other communication and failure or delay in services from subcontractor due to circumstance specified here. These circumstances shall constitute a basis for exemption which entails exemption from damages and other penalties. Should any such situation arise, Home Art ´N´ Gallery will inform you partly at the beginning and partly at the end of the time for the current situation. If the circumstance has lasted longer than two months, both you and Home Art ´N´ Gallery have the right to cancel the purchase with immediate effect.

12. CHANGES TO TERMS

Home Art ´N´ Gallery reserves the right to make changes to these Terms and Conditions at any time. Any changes to these Terms will be posted on the Site. Changes apply from the moment you have accepted the Terms (in connection with a new purchase or when visiting the Site), alternatively 30 days after Home Art ´N´ Gallery has informed you of the changes. However, Home Art ´N´ Gallery recommends that you keep updated on the Page regularly to be aware of any changes to the Terms and Conditions.

13. INVALIDITY

If a competent court, authority or arbitration panel should find that any provision of these Terms is invalid or unenforceable, the provision in question and all other provisions shall be valid and enforceable to the extent permitted by applicable law. The provisions declared invalid or unenforceable will be replaced by relevant legal guidance and advice.

14. GOVERNING LAW AND DISPUTES
 

14.1

Disputes must primarily be resolved amicably after discussion with Home Art ´N´ Gallery customer service.

14.2

If the dispute cannot be resolved in agreement with Home Art ´N´ Gallery customer service, you as a customer can turn to ARN (Allmänna reklamentationsnämnden), which you can find more information about at www.arn.se.

You can also submit complaints directly online via the European Commission's platform for mediation in disputes, which you can find via the following link http://ec.europa.eu/consumers/odr.

If you submit a complaint via this platform, your case is automatically forwarded to the appropriate nationally responsible dispute resolution body. This dispute resolution body then contacts us and tries to resolve the dispute without court involvement. In the event of a dispute, Home Art ´N´ Gallery follows the decision of ARN or the corresponding dispute resolution body.

14.3

Disputes concerning the interpretation or application of these Terms and Conditions shall be interpreted in accordance with Swedish law and decided in accordance with point 14.2 above or in the last instance by a general court.
